A Somerset takeaway owner has been fined for unlawfully disposing of waste in public bins. The owner of UK Kebab in Frome, Somerset, was found to be using public litter bins and other locations to dispose of business waste.
Eyub Saliev, the owner, admitted to contraventions relating to fly tipping and commercial waste duty of care under the Environmental Protection Act 1990. He was fined £865, reduced from £1,297 due to an early guilty plea. In addition to the fine, he was also ordered to pay a compensation of £2,052 to Somerset Council, along with covering legal and investigation costs of £1,887 and a victim surcharge of £346, totaling an amount of £5,150.
The court noted that Saliev had previously received fixed penalty notices and a formal caution in 2021 for similar offenses. Magistrates highlighted the reckless behavior he exhibited in handling controlled waste, especially given his past interactions with the council.

Cllr Federica Smith Roberts emphasized the legal responsibility of business owners to dispose of their waste in compliance with the law. She stated that while the preference is to assist businesses in doing the right thing, prosecutions for fly tipping will be pursued when necessary.
