Somerset Council Reverses Approval of Industrial Units Near A303 Amid Legal Disputes

Somerset Council has reversed its earlier approval of a development project near the A303, halting plans to construct 34 light industrial ‘starter’ units in Sparkford. The decision comes after prolonged legal disputes and local opposition raised concerns about flooding and environmental impact.

Anthony Canvin submitted the application in June 2022 to build up to 34 small industrial units off the A359 High Street in Sparkford. Designed to support local small businesses, the project aimed to deliver eight business blocks on a greenfield site situated between the former Haynes publishing property and a planned residential and care home development.

Despite residents' voiced concerns over flooding risks, noise, light pollution, and the loss of green space, Somerset Council’s southern planning committee initially approved the scheme in October 2024 with a condition limiting overnight HGV parking. However, subsequent negotiations stalled due to the applicant’s refusal to meet certain financial obligations required to finalize legal agreements.

Planning officer Michael Lowe detailed the impasse in a report on January 15, highlighting that Canvin declined to contribute to council legal costs or commit financially to sustainable travel initiatives, including electric vehicle charging infrastructure. This failure to finalize a Section 106 agreement meant the development did not meet local policies promoting sustainable travel, creating a conflict with the South Somerset Local Plan.

Under council regulations, planning officers have the authority to refuse developments already approved at committee if associated legal agreements are not secured. Exercising this power is rare but was applied here due to significant delays and outstanding issues.

The council plans to review all such outstanding agreements at a strategic planning committee meeting in Taunton later this month. Meanwhile, local residents like Sparkford Parish Council member Richard Squires remain concerned about the long-term environmental and social impact of the proposed industrial site on their community.
